Website Agreement
Baraa Salama, Queens, New York.
This is the whole agreement between Baraa Salama ("I", "me") and the person or business who completes the payment ("you"). You accept it by ticking the box on the payment page before you pay. Your name, your email, your phone and your billing address are the ones you enter there, and your start date is the date of your first payment. Nothing else needs signing.
1. What I do. I build you a website, put it online, and keep it online. I make small updates to it for as long as you are a paying client.
2. What you pay. $100 every 4 weeks, plus any sales tax that applies. No setup fee, no deposit, no build cost.
Every 4 weeks is not the same as monthly. It means 13 payments in a year, not 12, and the date moves forward by a couple of days each time rather than landing on the same date every month. Your first payment is the day you complete the payment page and every payment after that is 4 weeks later. Payment is handled by Stripe.
Your rate does not change for as long as you stay a client without interruption. I may quote different prices to new clients. That has no effect on you. The one exception: if a cost outside my control changes, meaning what I am charged for hosting or for your domain, I will give you 60 days written notice before anything about your price moves. Short of that, your rate is fixed.
3. What the payment covers. Your website, up to 10 pages in total; your web address, including its yearly renewal; hosting; keeping the site running, including security and uptime; swapping out text; swapping out photos; answering you when you text. Four more things are included:
(a) A chat assistant on your website. It tells every visitor it is an automated assistant, answers only from facts you have approved (such as your hours, your services and the area you cover), takes the visitor's name and number, and passes them to you.
(b) A missed call text back. If your phone is an Android, I help you set up an app on your phone that sends a text you approve to anyone whose call you miss, from your own number. If your phone is an iPhone, I set up a saved reply you can send in one tap instead.
(c) A one-time check of your Google Business Profile when your site goes live. I add your new website to it and check that your hours, category, service area and description are filled in, following Google's rules. I never change your business name. Google reviews every edit and decides when it shows, so that timing is not part of either promise in section 8.
(d) A review section on your website, plus the same review page as a link you can text to your customers. A customer who taps four or five stars is sent to your Google review box. A customer who taps one to three stars is shown a private form that goes to your inbox instead. You send the link yourself; I do not text your customers.
Reasonable use, no counter, no ticket limit. If your requests grow into something plainly different from this, we talk about it before I do the work and before anything is charged. I never do extra work and bill you without telling you first.
4. What it does not cover. Quoted separately, before I start: more than 10 pages; new sections; layout or design changes; rewriting your copy; logo or branding work; online booking, payments, e-commerce, or any system that connects to another system other than (a) and (b) in section 3; SEO campaigns; ongoing Google Business Profile work such as posts or review replies; anything carrying a bill from someone other than me. You are always told which category a request falls into before any work happens.
5. Your web address. It is included in what you pay. I register it on my own registrar account and pay for the registration and every yearly renewal. You pay nothing for it for as long as you are a paying client. Whenever you ask, including after you cancel, I move it into a registrar account in your name; any fee the registrar charges for that move is yours. If anything else ever carries an outside bill, I tell you the amount before you agree to it.
6. What is yours. Your web address: I move it into your name whenever you ask (section 5). Your content: photos, words, reviews. Your website files, copy available at any time including if you leave (section 9). Enquiries from your website: they belong to you, I pass them to your inbox and use them for nothing else. Your Google Business Profile: remove my access whenever you want.
7. What I hold. The registrar account your web address is on until you ask for it, the hosting account, the site's source files, the form service that delivers your enquiries, and the service that runs the chat assistant. You are paying for your site to be online and looked after, not for those accounts.
8. Timing, and what happens if I miss it. Your site, every page of it, goes live within three business days of my having everything I need: your photos, your text, and any access I asked for. The clock starts when your content arrives, not when you pay. After launch, section 3 updates are live within two business days of my having what I need. The missed call text back needs your phone in your hand for a few minutes, so it is set up on a call we book together and is not part of the three business day promise.
Two promises, and what I owe you if I break either one:
(a) If your site is not live within three business days of your content reaching me, you do not pay anything further until it is live.
